Quick Restore — End User License Agreement

This End User License Agreement ("Agreement") is between you ("you", "Licensee") and Poly Bright Ventures ("we", "us", "PolyBright", "Licensor") governing your use of the Quick Restore WordPress plugin and any updates, documentation, or license keys provided with it (the "Software").

By purchasing, downloading, installing, activating, or using the Software, you agree to be bound by this Agreement.

1. Definitions

"Software" — the Quick Restore plugin, Free and paid editions, including all files, updates, and documentation. "License Key" — the unique code issued to you on purchase. "Site" — a single, distinct WordPress installation identified by its domain, subdomain, or subdirectory URL. "Tier" — Free, Pro, Pro Plus, or Max. "Activation" — validating your License Key against our license server for a specific Site.

2. Grant of License

Subject to your compliance with this Agreement and payment of the applicable fee, we grant you a non-exclusive, non-transferable, revocable license to install and use the Software on the number of concurrently active Sites permitted by your tier: Free — unlimited (Free features only); Pro — 1 Site at a time; Pro Plus — 1 Site at a time; Max — up to 5 Sites at a time.

"Concurrent" means active at the same time — you may deactivate the Software on one Site and activate it on another as often as you reasonably need (migrating hosts, changing domains, rebuilding a Site). Deactivating a Site frees its activation slot immediately. Development, staging, and local Sites do not count against your concurrent-Site limit. WordPress Multisite networks are not covered.

3. License Key

Your License Key is confidential and personal to you. You may not share, resell, sublicense, publish, or distribute it. We monitor activation activity; unusual patterns — such as a single-Site key cycled rapidly across many unrelated production domains — may be flagged for review and, if abuse is confirmed, suspended. Legitimate Site moves are never penalized.

4. Upgrades and Tier Changes

You may upgrade tier at any time by paying the applicable price on our store. On upgrade, your existing License Key is upgraded in place — its tier changes on the next validation. No separate key is issued, and no reinstall or reactivation is needed.

5. Updates and Support

Free tier: updates for as long as the Software is offered, community support. Paid tiers: software updates and priority email support for twelve (12) months from purchase. After 12 months, the Software continues to work indefinitely on its last installed version — you stop receiving new updates and priority support until you renew. We never disable or degrade the Software when updates lapse.

6. What You May and May Not Do

You may: install and use the Software on the Sites permitted by your tier; modify the Software's code for your own use (licensed under GPLv3 — see §11); create and keep backups of your Sites using the Software.

You may not: share, resell, or sublicense your License Key; misrepresent the Software as your own product; use the Software unlawfully or to back up/restore content you do not have the right to handle; circumvent or disable the license validation system to obtain paid features without payment.

7. Refunds

All sales are final — we do not offer refunds. Because the Software is delivered instantly (download + license key), we encourage you to test the Free version on your Site first to confirm compatibility before purchasing a paid tier. 8. Data, Privacy, and External Connections

The Software stores backups within your own WordPress installation. We do not receive, access, or store your backups or site data. The Software connects to our license server solely to validate your License Key, check for updates, and manage activations — limited to your License Key, Site URL, and plugin version. Paid tiers may connect to a third-party cloud storage provider you choose and configure; those connections are governed by that provider's own terms. Our handling of your personal data is governed by our Privacy Policy.

9. Disclaimer of Warranty

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. Backup and restore operations are inherently risky — you are solely responsible for maintaining independent backups of your Site before performing any restore or migration. We strongly recommend keeping a separate, verified backup before overwriting any live Site.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, REVENUE, OR BUSINESS. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Open Source License (GPL)

The Software's PHP code is licensed under the GNU General Public License, version 3 (GPLv3) or later. This Agreement governs the License Key, paid feature entitlements, updates, and support — separate commercial services not part of the GPL-licensed code.

12. Termination

We may terminate or suspend your License Key for material breach (e.g. sharing your key, attempting to defeat the licensing system for commercial gain). On termination, your right to updates and support ends; your GPL rights to the code are unaffected.

13. Governing Law

This Agreement is governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts of Ahmedabad, Gujarat, India.

14. Changes to this Agreement

We may update this Agreement from time to time. Continued use of the Software after changes take effect constitutes acceptance of the revised Agreement.
